Terms of Service

By clicking "Accept & Continue" at signup, by accepting an invitation, or by continuing to use KENEK after these Terms are updated, you confirm that you have read and agree to these Terms and the Privacy Policy. If you do not agree, do not use KENEK.

If you accept on behalf of a company, you confirm you have authority to bind that company.

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. KENEK may allow you to invite team members; you are responsible for the invitations you send and for ensuring invitees are authorised.

KENEK is offered via subscription plans. Pricing, trial terms, billing, VAT and cancellation are described in the Billing & Cancellation Terms, which form part of these Terms.

Your use must comply with the Acceptable Use Policy and applicable law.

You own the business data you enter into KENEK. You grant KENEK a limited licence to host, process and display your content solely to operate the Service for you. Your use of personal information about your own clients, staff and contacts must comply with applicable privacy law; see the Privacy Policy and Data Processing Terms.

KENEK and its software, branding and design are owned by KENEK App (Pty) Ltd or its licensors. We grant you a limited, revocable, non-exclusive licence to use the Service per these Terms.

Subscription payments are processed by our payment provider (currently PayFast). Payment authorisation, risk and fraud checks are governed by the provider's terms. KENEK does not store full card numbers.

KENEK is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude warranties not expressly stated in these Terms. We do not warrant the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential damages. Each party's aggregate liability is limited to the amount you paid KENEK in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (for example, gross negligence or wilful misconduct in some jurisdictions).

You agree to indemnify KENEK against claims arising from your misuse of the Service, your breach of these Terms, or your violation of law or third-party rights.

You may cancel at any time. KENEK may suspend or terminate access for breach of these Terms, non-payment, or legal compliance reasons, with notice where reasonable.

We may suspend access for security, maintenance, or compliance reasons, with notice where reasonable.

We may update these Terms and pricing. Material changes take effect prospectively. We will use reasonable efforts to notify active users of material changes. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of the Republic of South Africa. Subject to your consumer rights, disputes are subject to the jurisdiction of the South African courts.
